All Pass2America real estate investments will be subject to Pass2America's Investment Criteria:

All Pass2America / Pass2NY real estate investments will be subject to federally required investment criteria:

The subject property must be able to retain or create ten (10) full-time direct or indirect jobs for each $900,000 invested. Pass2America / Pass2NY will achieve this by developing build-to-suit construction projects for specific companies, bringing them to the regional center, or working within the regional center with existing companies interested in a specific building to maintain jobs or to update an existing facility and bring new jobs into the regional center. 

Pass2America / Pass2NY is able to work with the following approved industry types in order to bring companies into the regional center or redevelop and maintain company projects within the regional center.  At Pass2America / Pass2NY we are constantly updating this list to add industries that may be pertinent to the investors or project at hand.

The targeted project size: $5,000,000 to $250,000,000.

Troubled Business Investment Criteria:

To qualify the business must:

  1. The business must have existed for at least two years.
  2. Invest in a business that has incurred a net loss, based on generally accepted accounting principles, for the 12 to 24 month period before you filed the Form I-526 Immigrant Petition by an Alien Entrepreneur.
  3. This loss for the 12 to 24 month period must be at least equal to 20 percent of the business's net worth before the loss.
  4. Maintain the number of jobs at no less than the pre-investment level for a period of at least two years.
  5. Be involved in the day-to-day management of the troubled business or directly manage it through formulating business policy. For example as a corporate officer or board member.
  6. The same investment requirements of the new commercial enterprise investment apply to a troubled business investment ($1,800,000 or $900,000 in a targeted employment area
